Terms and conditions of the Chef card

Latina Grocery Inc. is proud to announce our new Chef Program as a way to show our gratitude for your contributions in the growth of Chef food availability. As a member you are aiding us continue our mission to sell the highest quality natural and organic products available.

The following rules, terms and conditions include: membership information, how to collect and use Latina Dollars and other aspects of the Chef Program.

It is the customer’s responsibility to read closely and understand the rules, terms and conditions. Furthermore, it is important that this document be kept in a safe location. Any use of the customer’s LATINA Chef Card through this program implies that the customer has read and accepted the following conditions. The term “Card holder” refers to anyone who has an LATINA Chef Card issued in their name by Latina Grocery Inc.

Membership terms and conditions


Membership form

A membership is free, simply proceed to the Latina checkout counter and ask for a LATINA Chef Card. You must produce, if asked, a valid I.D. with your picture and/or birthday. Next, create your user profile online; visit www.chezlatina.com to find the application form or send a signed and completed application to the following address : “LATINA Chef Program”, Latina, 185 St-Viateur West, Montreal H2T 2L4. Access will give you offers and other advantages pertaining to your account. One LATINA Chef Card per person.

The Card holder must complete the application process within 30 days after his first purchase to activate the card.

By completing the activation process or by using his Latina Chef Card for the first time, the customer:

1. Certifies that they’re of legal age (or with the consent of a parent or guardian);
2. Accepts that Latina Grocery Inc. is collecting and using personal information except if notified otherwise;
3. Accepts the terms, conditions and rules of the Latina Chef Card Program. Latina Grocery Inc. may change those rules without notice and at any time.

Customers living at the same address are considered exclusive card holders, and will collect LATINA Dollars separately on each of their LATINA Chef Card.

Businesses, joint ventures, partnerships, groups and associations can also apply for Chef Program membership or the Chef Program membership.

The customer gives his consent to the collection and use of his personal information according to the rules established by Latina. (Refer to confidentiality section for more information).

How to collect LATINA Dollars

To gather LATINA Points, the Chef Member must present their LATINA Chef Card at the Latina Grocery Inc. check out before completing a transaction. If the Chef Member does not produce their card, they will not be able to gather the LATINA Dollars from this transaction. We reserve the right to not reimburse then restart a transaction for LATINA Dollars if one forgets to produce thus card.

Chef Member Account

LATINA Dollars will be automatically saved in the Member’s account. The LATINA Dollars will appear as soon as the transaction is completed.

LATINA Dollars Value

The value of LATINA Dollars earned during a purchase is one percent (1%) of the value of a participating product in an LATINA store (before taxes). The Program Administrator can, to his sole discretion, alter this percentage on some participating products; in this event, the length and bonifications will also be to the sole discretion of the Program Administrator.

Limits

A customer has no limited amount of LATINA Dollars he can gather. However, LATINA Dollars have to be spent within five(5) years of the purchase date.

Value

One (1) LATINA Dollar is equivalent to one Canadian Dollar ($1 CAN). LATINA Dollars cannot be traded in legal tender for their value nor can they be used in any other transaction but the ones allowed in these Rules. The Program Administrator can, to his sole discretion, make any other decision related to the use of LATINA Dollars.

Promotional offers

All products already in promotion may not be admissible for LATINA Dollars.

Balance

To check your LATINA Dollars account balance, proceed to the Latina checkout area. You may also check your balance by heading to www.chezlatina.com.

Latina Grocery Inc. may, to its sole discretion, grant from time to time, additional LATINA Dollars when specified products are purchased or during promotional events. These specials will be posted on www.chezlatina.com and /or in store.

A balance check of your LATINA Chef Card will be done at every purchase to make sure that LATINA Dollars are available for payment. LATINA Dollars may be collected even if the activation has not been completed. However, to use the LATINA Dollars, it is mandatory to complete the activation process.

Returns

When merchandise is returned, credited or reimbursed to a participating store, LATINA Dollars given during the transaction will be subtracted from the customer’s account. The LATINA Chef Card will have to be shown for the return transaction.

If LATINA Dollars are used as a method of payment for a purchase and that purchase is cancelled, the LATINA Points will be returned to the customer’s account and will not be reimbursed in money. The LATINA Chef Card must be available to complete the transaction.

The transfer of LATINA Dollars

Accumulated LATINA Dollars cannot be transferred (partial or whole sum) to another person. Two (2) exceptions can be granted by Latina Grocery Inc:

1. If the holder of the account dies, the membership and gathered LATINA Points in the account may be transferred to the designated person by right of succession and will be subject to the same earning and exchange rules, upon presentation of the death certificate and the original holder’s card (which will then be voided). If the designated person declines membership, the card and all cumulated LATINA Points will be cancelled.

2. In the event of a divorce or separation, conjointly cumulated LATINA Dollars may be transferred or split according to the party’s agreement, the court’s final judgement or according to the laws applicable to this matter in the province of Quebec.

Expiry and cancellation

If a LATINA Chef Card has not been used for a period of twelve (12) months, a reminder to use your LATINA Chef Ccard within the next six (6) months will be sent via e-mail. After this period if no purchase have been made, or if the holder cancels his LATINA Chef Card, all LATINA Dollars in his account will be cancelled without compensation within the next ten (10) days.

Lost or stolen Card

If your LATINA Chef Card is stolen or lost, it’s your responsibility to inform the Program Administrator immediately. All LATINA Dollars in the account will be transferred to your new account as soon as a new card has been emitted in your name.

Latina Grocery Inc. cannot be held responsible for all transactions made since the theft or the loss and the time the Program Administrator has been informed of the situation.

Program violation or fraud

Any violation or fraud pertaining to the Program, including false information provided by the customer or non-compliance to the present terms and conditions can result in the cancellation of the LATINA Chef Card and all cumulated LATINA Dollars.

Reasonable motives such as, trickery, abuse, embezzlement, card cloning or any other unacceptable and unauthorized act by Latina , will result in the cancellation of all LATINA Dollars, without notice.

Program modifications

Latina Grocery Inc. reserves all rights to terminate, suspend, modify the Chef Program and to add, withdraw of modify any condition of the Program without notice. In the event that the Program is to be terminated, Chef Members will be granted a period of three (3) months to spend their remaining LATINA Dollars, but will not be able to accumulate more.

Program suspension and cancellation

If the Program is or could be compromised as a result of causes beyond control of the Program Administrator and/or for serious reasons. Latina Grocery Inc. reserves the right to suspend or end the Program. All LATINA Dollars will no longer be available for use.

Computer problem

The Administrator and LATINA are not liable for faulty computer components, programs, or communication lines relating to the loss or absence of network communication; or any faulty, erased computer, network transmissions limiting or stopping anyone in participating to the program. The Administrator and Latina are also not liable for any damages or loss caused, directly or indirectly, from downloading any internet pages or software and by transmitting any information concerning participation to the Program.

Web site operation

The Administrator does not guarantee in any way that the website or any related website will be accessible, unfaulty or functional without any interruption of service during the length of the Program.

General Information

The terms for implementing this Program are subject to laws and regulations in effect in the province of the holder of the LATINA Chef Card; as well as those of Canada. In the event that any disposition included herein is declared invalid or illegal, such disposition or part thereof should then be deemed null and void and the remaining dispositions contained herein shall remain in effect.

Any information request pertaining to the Program must be sent by e-mail to Latina Grocery Inc. or by post, addressed to the Program Administrator. It will be the responsibility of the customer to pay Federal or Provincial taxes (including the income tax) if it becomes compulsory to do so on the collection and exchange of LATINA Dollars.

Confidentiality

Personal information gathered during the implementation of the Program will be only used by Latina Grocery Inc. They will not be sold or leased to other companies or agencies. This information is necessary for the Program’s management of member accounts, as well for the process of exchange and grant rewards of Latina Dollars. Also, to better understand the needs and preferences of members and improve customer service. Personal information about members are considered an asset linked to the Chef Program and, in the event of a sale or a title deed transfer of Latina, this information will be transferred as an asset of Latina.

However, Latina Grocery Inc. may and will, as legally requested, share any information related to points granted to customers, particularly to tax authorities, if applicable.

Information transmitted to Latina Grocery Inc. upon membership may also be used to communicate with card holders to inform them of future events and special or exclusive offers. If you do not wish to receive any communications from Latina, please inform Latina Grocery Inc. by e-mail chefcard@chezlatina.com or by post, addressed to the Program Administrator. Each card holder must provide Latina Grocery Inc. with a valid address so that any information pertaining to the Program can be sent by post. Latina Grocery Inc. is not liable if the card holder does not receive any circulated information or if the information is received close or past the announcement.

Liability limitation

Any card holder releases Latina, its subsidiaries, its affiliates and its director or administrators of any contractual liability or responsibility resulting directly or indirectly related to the Chef Program or from registration to the Program.
